STANDARD TERMS AND CONDICTION

DEFINITIONS

Commercial properties include hotels, lodges and villas globally.

GENERAL

  • This is a commercial property booking where Nyanduse Travels is acting as the agent
  • A 50% rental deposit is required along with the fully completed booking form to confirm your booking.
  • The balance of fees (Including damage deposit) is required between 45 – 60 days prior to occupation, depending on which accommodation you book
  • Please check the booking form – this will show you how many days prior to occupation the 50% balance of fees (Including damage deposit) is due.
  • All payments made in SA Rands, Kshs, Euros, US Dollars or UK pounds will be specified on the booking form, free of bank charges.
  • If taking a property in its entirety (exclusive) the residence may not be occupied by anyone other than the Client and the Client’s guests (including children) whose names appear on the Rental Agreement.
  • Unless otherwise agreed in writing prior to confirmation of the booking, the property may not be used for any purpose other than private rental accommodation.
  • No parties and events are allowed


CANCELLATION POLICY

  • The cancellation terms mirror those of the commercial property and will be detailed on the booking form.


BREAKAGES AND DAMAGE

  • Clients will be charged for damages caused by tampering with the establishment’s systems.
  • Breakages and damage, including stains and scratches (beyond normal wear and tear) will be deducted from the damage deposit (if applicable) and, should the damage deposit (if applicable) not be sufficient to cover the damage, the Client will be invoiced for the outstanding amount.
  • Damage deposits (if applicable) will be refunded within five (7-14) working days of departure.
  • Damage deposits charged from a debit or credit card will be refunded to the same debit or credit card within five (7-14) working days of departure.
  • Bank charges relating to refunding of damage deposit to foreign bank accounts will be for the Client’s account. It is recommended that foreign Clients rather provide a credit or debit card which can be debited and refunded without either party incurring bank charges in the case where a full refund is made.
  • The agreement to which these terms and conditions are attached is of no force and effect unless confirmed by Nyanduse Travels in writing.

DURATION

  • These T&Cs are valid for the duration of your booking.

LIABILITY

  • The Client is liable for any damage to the establishment, equipment or to the surrounding fauna and flora incurred by the Client, and/or the Client’s guests.
  • Neither the owners of the establishment nor Nyanduse Travels accept any responsibility whatsoever for any loss or damage to persons or property of the Client or the Client’s guests and the premises are used entirely at the occupants’ own risk.

TRAVEL INSURANCE

We strongly recommend that our clients take out fully comprehensive travel insurance in the unlikely event their accommodation has to be cancelled for reasons out of our control. Rather safe than sorry!

LOAD SHEDDING

FOR ESTABLISHMENTS WITHIN SOUTH AFRICA – LOAD-SHEDDING DISCLAIMER :

Please note that South Africa’s electricity supplier, Eskom, has implemented load-shedding (scheduled power outages) for the foreseeable future. The vast majority of our commercial establishments are either fully off-grid or have partial or full back-up systems in place during periods of load shedding.

Currently load-shedding is part of the South African experience; it is beyond our control and Nyanduse Travels cannot be held accountable for any gap between our client’s expectations of a load-shedding provision, and the actual provision. Our friendly and knowledgeable team will be happy to confirm the power provision at each property. It is important that you consider what you will need during a spell of load-shedding and chat to the team to ensure your home away from home has sufficient provision for your needs.

COVID-19 CANCELLATION POLICY

Covid 19 is now a part of our everyday lives for the foreseeable future and we are all aware of the risks involved where travel is concerned.

Further to this we are also responsible to offer some level of ‘fairness’ to both our Clients and to our establishment owners. It has therefore been decided that if you are unable to travel due to any of the following reasons you may defer your booking to the same property for up to one year from your original arrival date:

  • Where the country of your accommodation closes their borders and enforces a travel ban.
  • Where the government of the individual making the booking’s country of residence has closed its borders to all but essential travel.

POPIA

The South African Protection of Personal Information Act (POPI Act) is designed to protect  how your data is used, stored, and processed. By signing these Terms & Conditions I hereby acknowledge that our/my personal and in certain instance my special personal information are required by NYANDUSE TRAVELS in order for my booking/enquiry to be facilitated and I/we agree to provide such information requested from NYANDUSE SS, on the express understanding that:

  • This constitutes my/our consent, as required under Section 11(1)(a) of the Protection of Personal Information Act 4 of 2013 (“POPIA”).
  • The NYANDUSE TRAVELS support services staff and the finance department of NYANDUSE TRAVELS will access my/our information which has been furnished to them for the purposes of the transaction in which I am/we are involved and matters ancillary thereto.
  • NYANDUSE TRAVELS are authorised to release my/our personal information to the hosts of the short- or long-term accommodation, tour operators and other third parties in respect of which my booking or enquiry relates.
  • NYANDUSE TRAVELS do not intend sharing my/our personal information for financial gain.
  • I/we acknowledge that our/my contact details are automatically added to the NYANDUSE TRAVELS database and that NYANDUSE TRAVELS send out bulk emails to its database from time to time containing property news, listings and other service offerings from NYANDUSE TRAVELS and similar content. We/I are aware that I am/ we are entitled to OPT OUT/UNSUBSCRIBE from these bulk emails by exercising the OPT OUT/UNSUBCRIBE options available on the email or by contacting the Information Officer of NYANDUSE TRAVELS with a request to remove my/our details from the emailer list.
  • In the event that our/my booking or enquiry involves a child or children, I/we acknowledge that I am/we are the competent adult/s responsible for such child or children and willingly supply their personal information in order to include them/him/her in the booking or enquiry through NYANDUSE TRAVELS.
  • NYANDUSE TRAVELS have implemented proper Data Privacy rules in respect of their management of Client information as well as proper Internet Usage Rules and Cyber security principles in order to minimise the risk of my/our information being exposed to Cyber risks and I/we have had an opportunity to read through such Policies and understand that it is my/our own duty to protect our own internet and email connections against interceptions and viruses.
